Acclaimed S.C. lawyer Mark Tinsley and Myrtle Beach lawyer Natasha Hanna are representing the family of Scott Spivey in a soon coming civil lawsuit against North Myrtle Beach restaurant owner, Weldon Boyd.

The facts are Scott Spivey spent the afternoon drinking in BoardWalk Billy’s in 2023. After running up a $109.11 bar tab, that did include a $13.95 cheeseburger and chips, Scott Spivey left the bar and started driving home in his black pickup with his 45 caliber pistol. His blood alcohol level was .13.
According to Pinelands Recovery, a center for alcohol abuse, a .13 blood alcohol concentration (BAC) indicates a level of intoxication where gross motor impairment, blurred vision, and a loss of balance are likely. It also suggests that the person may experience anxiety, restlessness, and their sense of judgment is significantly impaired.
Scott Spivey was in no condition to drive, most likely anxious, restless and exhibiting poor judgement.
Weldon Boyd and other witnesses claim Scott Spivey attempted to run him off the road. According to Mr. Boyd and his friend, Kenneth Williams, who were in the same vehicle, Spivey blocked Camp Swamp road, stopped his black truck and proceeded to unload a gun magazine of ammo at Boyd.
Boyd claims he fired back and fatally shot Spivey, alleging self-defense under South Carolina’s castle doctrine.
Police found Spivey dead in his front seat hunched over his center console with a handgun just underneath his hand.
In April 2024, 911 calls from Horry County police detailed what Boyd and a witness saw and heard.
Horry County police released five calls linked to the shooting event. One of the calls was from Boyd to dispatch, stating he would shoot Spivey if Spivey persisted in brandishing a gun in front of him.
Last April, Boyd was not prosecuted by the state Attorney General’s Office due to a lack of evidence. This occurred subsequent to a request for assistance from 15th Circuit Solicitor Jimmy Richardson to the agency, as they aided Horry County Police after a social media post by Boyd expressed gratitude to the authorities following their encounter.

The Horry County Council is implicated due to the resignation of former Horry County Deputy Chief Brandon Strickland, who is under investigation for alleged misconduct during the case that was initially handled by the Horry County Police Department.
Although Boyd and Strickland were recorded in ongoing discussions, the essential truth remains unchanged. Boyd, the proprietor of Buoys on the Boulevard in North Myrtle Beach, was not formally accused in the inquiry due to insufficient evidence, according to the South Carolina Attorney General’s Office.

The Spivey family is a prominent name in the Tabor City area, yet there have been no talks about constructing a monument to recognize Scott Spivey’s selfless contributions in the Tabor City community.
